Big family changes have already just taken place, and now you are required to spend many hours of your personal time following what can sometimes be arcane and delicate processes. Probate is a legal process that involves administering the estate of a deceased person and includes many phases – some optional, but usually required – wherein you: 

  • Appoint an executor or administrator to manage the estate 
  • Validate the decedent’s will with the court
  • Determine the pool of beneficiaries 
  • Collect the deceased's assets 
  • Notify and pay creditors 
  • File tax returns and pay any taxes due
  • Distribute remaining assets to beneficiaries 

It's definitely a good idea to consult an attorney to determine if probate is necessary and what part(s) of the overall process are applicable to your specific situation.
